To get a divorce in Illinois, either you or your spouse must have been a resident for at least 90 days before you start the process. You will also need to provide an official reason. For many couples, this reason is simply that the marriage is irretrievably broken. Divorces are finalized as soon as the judgment is entered.
Apart from agreeing to end the marriage, you may also need to reach an agreement with your spouse on various other matters. These could include property division, child custody, child support, and spousal support.
As mentioned in the previous section, Illinois law does not require you to prove wrongdoing to get a divorce — you may agree with your spouse to end the marriage. In other words, Illinois is a no-fault state.
